1. Overview
Welcome to Radiance Naturelle.
These Terms of Service (“Terms”) govern your access to and use of the website, online store, products, content, features, tools, and related services operated by Radiance Naturelle inc. (“Radiance Naturelle,” “we,” “us,” or “our”), collectively referred to as the “Services.”
Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.
By visiting our website, creating an account, placing an order, or otherwise using the Services, you agree to these Terms and to the policies incorporated into them, including our Privacy Policy, Shipping & Delivery Policy, and Returns & Refunds Policy.
If you do not agree to these Terms, you should not access or use the Services.

3. Eligibility and Customer Accounts
You must have the legal capacity required in your place of residence to enter into a purchase contract.
If you have not reached the age of majority, you may use the Services or make a purchase only with the involvement and authorization of a parent or legal guardian where required by law.
When creating an account or placing an order, you agree to provide information that is accurate, current, and complete.
You are responsible for:
• maintaining the confidentiality of your account credentials;
• restricting access to your account and devices;
• reviewing the accuracy of your contact, billing, payment, and shipping information;
• notifying us promptly if you believe your account has been accessed without authorization.
You may not sell, transfer, assign, or provide your customer account to another person.
4. Product Information
Radiance Naturelle offers cosmetic and beauty products, including products intended for use on the lips.
We make reasonable efforts to present product descriptions, ingredients, shades, finishes, dimensions, photographs, and other information as accurately as possible.
However, the appearance of a shade may vary because of factors including:
• screen brightness and display settings;
• lighting conditions;
• photography;
• natural lip colour;
• skin tone;
• the number of layers applied;
• other lip products worn underneath.
A difference caused by these factors does not necessarily mean that the product is defective or incorrectly described.
Customers should review the product description, ingredient information, instructions, and warnings before use. Do not use a product if you know that you are allergic or sensitive to one of its ingredients.
Discontinue use if irritation or an unexpected reaction occurs. Seek appropriate professional advice when necessary.
Our cosmetic products are not intended to diagnose, treat, cure, or prevent a medical condition.
5. Product Availability
All products are subject to availability.
We may introduce, modify, limit, or discontinue products, shades, collections, packaging, promotions, or product quantities where permitted by law.
Placing an item in your shopping cart does not reserve the item or guarantee its availability.
We may impose reasonable quantity limits to prevent fraud, unauthorized resale, abusive purchasing activity, or purchases inconsistent with normal personal use.
6. Orders and Acceptance
Submitting an order constitutes an offer to purchase the selected products.
An automatically generated order confirmation acknowledges that we received your order. It does not necessarily confirm that the order has been finally accepted where applicable law provides otherwise.
Before an order is accepted, we may verify:
• product availability;
• payment authorization;
• billing and shipping information;
• suspected fraudulent or unauthorized activity;
• compliance with purchase limits;
• applicable legal or delivery restrictions.
We may refuse or place an order on hold before acceptance when reasonably necessary and permitted by law. If this occurs, we will attempt to notify you using the contact information supplied with the order.
Once a purchase contract has been concluded, Radiance Naturelle will fulfil its obligations in accordance with the contract and applicable law.
Please review your order carefully before submitting it. Changes or cancellations cannot be guaranteed once processing has begun.
7. Personal-Use Purchases
Unless we have expressly approved a wholesale or commercial arrangement in writing, products purchased through the Services are intended for personal or household use.
You may not purchase products for unauthorized resale, redistribution, export, counterfeiting, or another commercial purpose.
8. Prices, Currency, Taxes, and Charges
Unless otherwise stated, prices displayed on the Canadian store are shown in Canadian dollars.
Product prices, promotions, and discounts may change from time to time. The applicable product price will be the price properly presented and agreed to when the purchase contract is concluded, subject to mandatory law.
Applicable taxes, shipping fees, and other charges will be displayed during checkout before you submit payment.
You are responsible for reviewing the complete order total before completing the transaction.
Promotional offers may be subject to additional conditions, including:
• eligibility requirements;
• start and end dates;
• product exclusions;
• minimum purchase amounts;
• quantity limits;
• restrictions on combining promotional codes.
If promotional terms conflict with these Terms, the specific promotional terms will apply to the promotion, to the extent permitted by law.
9. Payment
Available payment methods are displayed during checkout and may include payment cards, digital wallets, accelerated checkout services, instalment-payment services, or other payment providers.
You represent that:
• the payment information submitted is accurate;
• you are authorized to use the selected payment method;
• sufficient funds or credit are available to complete the purchase;
• the payment provider may authorize and process the transaction.
Payments may be processed by Shopify Payments or another third-party payment provider. Those providers may apply their own terms, privacy practices, eligibility requirements, and approval decisions.
An order may remain pending until payment has been successfully authorized or confirmed.
We are not responsible for a payment provider’s independent decision to decline, delay, reverse, or investigate a transaction.
10. Final Sale and Refunds
For hygiene and safety reasons, all Radiance Naturelle lip products are final sale.
We do not accept returns, exchanges, or refunds because of:
• a change of mind;
• an incorrectly selected shade;
• personal preference concerning colour, texture, scent, or finish;
• a product being opened, used, tested, or removed from its original packaging;
• damage occurring after delivery through misuse, improper handling, or improper storage.
The final-sale policy applies even when a lip product remains unopened because returned personal-use cosmetics cannot be safely returned to inventory or resold.
This policy does not exclude or limit rights concerning products that are damaged, defective, incorrect, unsafe, or otherwise protected under applicable consumer protection laws.

11. Damaged, Defective, or Incorrect Products
If an order arrives damaged, appears defective, or contains an incorrect item, please contact us as soon as possible, preferably within seven days of delivery.
You may be asked to provide:
• your full name;
• your order number;
• a description of the issue;
• clear photographs of the product;
• photographs of the exterior and interior packaging.
Please retain the product and packaging until the review is complete.
Each situation will be evaluated individually. Depending on the circumstances and applicable law, an appropriate resolution may include a replacement, refund, or another reasonable remedy.
The suggested seven-day reporting period helps us investigate promptly and does not remove rights that cannot legally be limited.
12. Order Changes and Cancellations
If you need to request an order change or cancellation, contact us as soon as possible.
We will make a reasonable effort to assist, but we cannot guarantee a change or cancellation after:
• processing has begun;
• the shipping label has been created;
• the order has been transferred to the carrier;
• the order has already been delivered.
Any cancellation rights available under mandatory consumer protection laws remain unaffected.
13. Shipping and Delivery
Radiance Naturelle currently ships to eligible addresses within Canada.
Processing and delivery estimates are provided in our Shipping & Delivery Policy and during checkout where applicable.
Delivery times are estimates and may be affected by circumstances outside our reasonable control, including:
• carrier delays;
• severe weather;
• statutory holidays;
• high seasonal volume;
• service interruptions;
• incorrect or incomplete delivery information.
Customers are responsible for providing a complete and accurate shipping address.
If a delivery problem occurs, please contact us so that we can review the situation and, where appropriate, communicate with the carrier.
Nothing in these Terms limits any right a customer may have when an order is not delivered within the time required by applicable law.
14. Packages Returned to Sender
A package returned to Radiance Naturelle by a shipping carrier is not automatically considered an authorized product return.
A package may be returned because of:
• an incomplete or incorrect address;
• refusal of delivery;
• failure to collect the package;
• unsuccessful delivery attempts;
• another circumstance outside our reasonable control.
If this occurs, we may contact the customer to discuss the available options.
Additional shipping fees may be required before the order is sent again. Original shipping fees are generally non-refundable unless otherwise required by law or the issue resulted from an error attributable to Radiance Naturelle.
A package being returned to sender does not automatically qualify the customer for a product refund.
15. Intellectual Property
The Services and their content are owned by or licensed to Radiance Naturelle inc. and are protected by applicable Canadian and international intellectual property laws.
Protected content may include:
• the Radiance Naturelle name and logo;
• trademarks and slogans;
• product and collection names;
• photographs and videos;
• website design;
• written descriptions;
• graphics and illustrations;
• packaging designs;
• marketing materials;
• product presentations;
• audio and other creative content.
The Services are provided for personal, non-commercial use.
Without prior written authorization, you may not:
• copy, reproduce, republish, distribute, sell, or commercially exploit our content;
• modify or create derivative works from our materials;
• use our branding in a manner suggesting an affiliation or endorsement;
• remove copyright, trademark, or ownership notices;
• download or store substantial portions of the website;
• use our product photographs or descriptions to sell or promote another business.
No licence or ownership right is granted except the limited right to access and use the Services in accordance with these Terms.
16. Reviews, Feedback, and Customer Content
You may have the opportunity to submit reviews, photographs, comments, suggestions, or other content.
You confirm that:
• you created the submitted content or have permission to use it;
• it is accurate and not misleading;
• it does not violate another person’s intellectual property, privacy, or other rights;
• any compensation, discount, gift, or incentive connected to the submission has been clearly disclosed;
• it does not contain unlawful, threatening, discriminatory, defamatory, obscene, fraudulent, or malicious material.
By submitting content, you grant Radiance Naturelle a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, and display it for operating, improving, and promoting the Services, subject to applicable privacy laws.
We may moderate or remove content that violates these Terms, but we are not required to publish or respond to every submission.
17. Prohibited Uses
You may use the Services only for lawful purposes.
You may not:
• violate any applicable law or regulation;
• infringe the rights of Radiance Naturelle or another person;
• submit false, misleading, or fraudulent information;
• impersonate another person or entity;
• engage in harassment, threats, abuse, or discrimination;
• upload malware, viruses, or harmful code;
• interfere with the operation or security of the website;
• attempt to gain unauthorized access to an account or system;
• collect personal information about other users without authorization;
• scrape, copy, extract, or systematically download website content without permission;
• use automated systems to interfere with checkout, inventory, security, or normal customer access;
• use the Services for spam, phishing, fraud, or another malicious purpose;
• purchase products for unauthorized resale or counterfeiting.
We may restrict or suspend access when we reasonably believe these Terms have been violated or when action is required to protect customers, the business, Shopify, or our service providers.

Third-party services are governed by their own terms and privacy policies.
We do not control and are not responsible for:
• the content or availability of third-party websites;
• their privacy or security practices;

• products or services purchased directly from them;
• losses resulting from a customer’s dealings with an unrelated third party.
Please review the applicable third-party terms before using those services.
19. Relationship With Shopify
Radiance Naturelle uses Shopify to provide the ecommerce platform supporting the Services.
Purchases made through our store are transactions between the customer and Radiance Naturelle inc., not between the customer and Shopify.
Shopify is not the seller of Radiance Naturelle products and does not control our product descriptions, inventory, fulfilment, customer service, returns, or business policies.
Shopify may process information and provide technology, checkout, security, payment, analytics, and other platform services as described in the applicable Shopify terms and privacy policies.
20. Privacy
Our collection, use, disclosure, retention, and protection of personal information are described in our Privacy Policy.
Because the Services are hosted by Shopify, some personal information is also processed by Shopify and other service providers that help us operate the store.
By using the Services, you acknowledge that you have had the opportunity to review our Privacy Policy.
21. Website Availability
We aim to keep the Services available, accurate, and secure. However, we cannot guarantee that the website will always operate without interruption, delay, error, or technical difficulty.
We may temporarily suspend or restrict access for:
• maintenance;
• updates;
• security concerns;
• technical failures;
• circumstances outside our reasonable control.
We may correct website errors or update information when reasonably necessary, subject to our contractual and legal obligations concerning completed orders.
22. Legal Warranties and Consumer Rights
Products sold by Radiance Naturelle remain subject to the legal warranties and mandatory protections provided by applicable law.
Depending on the applicable law, products must notably:
• be suitable for their normal intended use;
• remain usable for a reasonable period, considering their nature, price, and conditions of use;

• be free from hidden defects;

Nothing in these Terms, our final-sale policy, or another store policy excludes or restricts a legal warranty or consumer remedy that cannot lawfully be waived.
23. Disclaimer
To the extent permitted by law, the website and its general informational content are provided on an “as available” basis.
We do not guarantee that:
• website access will always be uninterrupted;
• every technical error will be corrected immediately;
• every feature will remain available indefinitely;
• general beauty information will be suitable for every individual circumstance.
This section does not apply to and does not exclude:
• mandatory legal warranties;
• obligations relating to products sold;
• representations forming part of a consumer contract;
• rights or remedies that cannot be limited under applicable law.
24. Limitation of Liability
To the maximum extent permitted by applicable law, Radiance Naturelle will not be responsible for indirect or consequential losses arising solely from circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.
The exclusions and limitations in these Terms apply only to the extent permitted by the law governing the transaction.
25. Indemnification
To the extent permitted by law, you agree to be responsible for reasonably foreseeable losses suffered by Radiance Naturelle as a direct result of:
• your unlawful use of the Services;
• your fraudulent activity;
• your intentional infringement of intellectual property rights;
• your material breach of these Terms.
This section does not require a consumer to assume liability that cannot lawfully be imposed.
26. Suspension and Termination
We may suspend or terminate access to a customer account when reasonably necessary because of:
• fraud or suspected fraud;
• unauthorized account access;
• serious or repeated violations of these Terms;
• unlawful activity;
• security risks;
• abuse of employees, customers, or the Services.
Termination does not affect obligations or rights arising before termination, including payment obligations and rights connected to an existing order.

We may update these Terms to reflect changes in:
• our Services or business operations;
• our products and policies;
• Shopify features;
• service providers;
• legal or regulatory requirements.
The revised Terms will be published on this page with an updated “Last updated” date.
Where required by law, we will provide additional notice of material changes.
Unless otherwise permitted or required by law, changes will not retroactively remove rights that already arose from a completed purchase.
28. Governing Law
These Terms and the use of the Services are governed by the laws applicable in Québec and the federal laws of Canada applicable there.
Customers may also benefit from mandatory consumer protection laws applicable in their province or territory of residence.
Nothing in this section requires a consumer to waive the jurisdiction, protections, or remedies that cannot lawfully be waived.
29. Severability
If a provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be applied to the maximum extent permitted or severed where necessary.
The remaining provisions will continue in effect.
30. No Waiver
A failure or delay by Radiance Naturelle to enforce a provision of these Terms does not waive our right to enforce that provision later.
31. Entire Agreement
These Terms and the policies incorporated by reference form the agreement governing your use of the Services and purchases from our store.
They replace earlier versions concerning the same subject, except where a prior right or obligation must remain in effect.
